ExtraVirginOliveOil.Store is the online store manager active through the website www.extravirginoliveoil.store.
For any clarification regarding these general sales conditions, the conclusion of the contract and its rules, the Customer is invited to contact ExtraVirginOliveOil.Store by sending an e-mail to the address info@extravirginoliveoil.store; in any case, any rights and faculties recognized by the applicable law are not affected.

1. Scope and definitions

These general conditions of sale apply to the supply and sale, through the website www.extravirginoliveoil.store, of the extra virgin olive oil in tin or bottle produced and packaged by ExtraVirginOliveOil.Store; regulate and form an integral and substantial part of all the contracts signed by the Customer with ExtraVirginOliveOil.Store. Forwarding an order, the customer declares to have acquainted and accepted the present general sales conditions, which prevail over any other general condition of the contract the application of which is invoked in relation to one or more contracts.

"Consumers" means any natural person who places an order for purposes other than business, commercial, craft or professional activity, if any; "Professional" means any natural or legal person who makes an Order in the exercise of his business, craft or professional activity; "Customer" means, as the case may be, the Consumer or the Professional; for "Contract" it is understood the contract between the Customer and ExtraVirginOliveOil.Store in accordance with the provisions of section 3 and precisely that stipulated at the time of the receipt by the customer of the confirmation of the Order receipt sent by ExtraVirginOliveOil.Store; for "business day" shall mean any day of the week, except Saturdays, Sundays and public holidays by law; for "Order" means the order or the orders submitted by the Customer to ExtraVirginOliveOil.Store in accordance with Section 3.

2. Consultation of the General Sales Terms and Conditions

These general terms of sale, together with the terms of the Contract, may be consulted at any time by the Customer on the website www.extravirginoliveoil.store.

The customer additionally has the ability to store his order data by downloading the general terms of sale and saving, through his browser, the data summarized on the web page preceding the forwarding of each order.

The data for each forward order will be saved by ExtraVirginOliveOil.Store on their IT systems. 3. Conclusion of the Contract

4. Price and shipping costs

www.extravirginoliveoil.store, provided that the price of items on offer within the site must be considered as indicated up to the moment of the sending of the Order. The customer is encouraged to ensure the final sale price of each products selected before submitting the order to ExtraVirginOliveOil.Store. The prices indicated are public prices, not including VAT and any other taxes, excluding transport costs of the carrier chosen by ExtraVirginOliveOil.Store, which, where provided, are specifically indicated by the web site interface when formulating the order.

5. Payment and delivery

Unless otherwise agreed, the customer is required to pay the full price of the ordered products at the same time as the order is forwarded. ExtraVirginOliveOil.Store reserves the right to deliver the products purchased only after receipt of payment of the order in its entirety. As part of the process of forwarding the order, ExtraVirginOliveOil.Store proposes, at its discretion, various payment instruments, such as credit card payment, PayPal payment, and payment by bank transfer in advance. Any commission fees charged by payment service providers are the exclusive charge of the Customer. For deliveries, ExtraVirginOliveOil.Store reserves the right to use a carrier at its own discretion. ExtraVirginOliveOil.Store, once received the payment of the order, will ship the products as soon as possible, stating that in the case of bank transfer payment, it reserves to dispatch after confirming receipt of bank credit.

ExtraVirginOliveOil.Store can not be held liable for the lack or delayed delivery if it is unable to compensate for the lack of availability of one or more ordered products and promptly notify the customer of the unavailability. In the event of a product being unavailable, even temporarily, ExtraVirginOliveOil.Store will inform the customer in an instant by e-mail, at the e-mail address indicated during the order process, and restoring to the customer the advance payments of unavailable products within 30 (thirty) days of receipt of the payment or receipt of the order.

6. Right of withdrawal

In accordance with applicable laws, as a consumer, the customer has the right to withdraw from the contract, without giving reasons, within 14 days.

The withdrawal period expires after 14 days from the day when the customer or a third party, other than the designated carrier, acquires the physical possession of the goods or acquires the physical possession of the last product in case ExtraVirginOliveOil.Store is proceeding to the separate dispatch of the goods to be purchased with a single order.

After the withdrawal, all payments made to ExtraVirginOliveOil.Store will be reimbursed to the customer for the scope of the order for which the withdrawal has been made, including delivery costs (except for any additional costs resulting from the choice of the Customer of the Fast Delivery Mode), without delay and in any case not later than 14 days from the day of receipt of the return statement. The customer undertakes to make the return of the goods received and the subject of withdrawal as soon as possible.

Refunds are made using the same payment method used by the customer for the initial transaction, unless otherwise expressly agreed upon by the customer; In any case, the customer will not be required to bear any costs as a consequence of such reimbursement.
Refunds may be suspended until receipt of returned products or until the customer demonstrates that they have returned the products.

In case of withdrawal the customer is required to return the product intact. 7. Cash Out of purchase vouchers

The purchase vouchers of the online shop www.extravirginoliveoil.store are valid up to the term indicated in each of them and can only be used once.

They are not redeemable in money, they are not cumulative, do not accrue interest, and are not transferable to third parties.

10. Limitation of Liability

ExtraVirginOliveOil.Store can not be held liable for any personal or non-pecuniary damage, whether direct or indirect, resulting from the Customer's misuse or abnormal use of a product, or defects due to improper storage of a product, which remains responsibility of the customer.

11. Data protection

ExtraVirginOliveOil.Store keeps the data of each order as well as the customer's contact details only to use them for the correct execution of the order (possibly also through the transmission to the trading partners involved in payment management, execution of the order and/or product shipment), any complaints, and recommendations or instructions provided to the customer. The processing of customer data is done in accordance with the Privacy Policy regarding the protection and use of personal data issued by ExtraVirginOliveOil.Store.

12. Applicable Law and Competent Jurisdiction

These general sales conditions, as well as the contracts concluded through the website, are drafted in Italian and governed by Italian law and in accordance with the same interpreted and executed.

In the case of contracts concluded with EU consumers, any dispute concerning the interpretation, validity and performance of the general conditions of sale will be subject to the indispensable jurisdiction of the court of the place of residence or domicile of the consumer.

The Consumer, as an alternative to judicial settlement of disputes relating to these general terms of contract, also has the right to access the "ODR" European Platform for the resolution of any disputes between the seller and the consumer. In the case of contracts concluded with professionals, or contracts concluded with consumers residing in non-EU countries where there is no provision for consumer protection, the Catanzaro Court will be exclusively competent to decide any dispute over the interpretation, validity and/or the execution of these general sales conditions, as well as the contracts concluded through the website.

13. Modification of the General Sales Conditions

ExtraVirginOliveOil.Store will inform the customer of the changes to the provisions of these general terms of sale through the updating of this web page. The modified general sales conditions apply to all orders forwarded by the customer after the receipt of the modification notice.

14. Final Provisions

Where a provision of the present or future provision of the general terms and conditions of sale or of the contract is or becomes wholly or partly ineffective or there is a shortage in the terms of the general terms and conditions of sale and / or contract, the remaining provisions of General terms and conditions of sale and contract will in any case be valid and effective.
